These Terms & Conditions ("Terms") govern the contract between you and Računarsko programiranje "EREBUS" s.p., operator of the Chesspoint service at chesspoint.io ("we", "us", "our"). By creating an account, subscribing, or otherwise using Chesspoint, you agree to be bound by these Terms and our Privacy Policy.

2. Description of the Service

Chesspoint is an online chess education and training service. The Chesspoint Membership provides authenticated users with access to:

• Structured text-based chess lessons and opening guides

• Interactive tactical puzzles rated to the user's level

• Calculation, checkmate-pattern and endgame trainers

• A game analysis board with a bundled chess engine

The service is provided as an online, browser-based digital service. No physical goods are delivered and no software download is required beyond the assets loaded by your browser to run chesspoint.io.

3. Ordering Process

A binding contract is formed according to the following steps:

1. You create a Chesspoint account or log in to an existing one.

2. On the Membership page you review the product description, the price (€4.99/month, VAT where applicable included), and these Terms.

3. You click "Subscribe" and explicitly confirm (i) agreement to these Terms and the Refund & Cancellation Policy, and (ii) that you request immediate performance of the digital service and acknowledge losing your right of withdrawal once performance has begun (see Section 6).

4. You are redirected to Monri WebPay, where payment is processed in a PCI DSS compliant environment. We never see or store your card details.

5. On successful payment, access is activated immediately and a receipt/invoice is emailed to your account email address.

4. Delivery of the Digital Service

Because Chesspoint is a digital online service, there is no physical shipment. Access is granted immediately after payment is confirmed by the payment processor — typically within a few seconds, and in any event within 24 hours. If activation has not taken place within 24 hours you should contact support at chesspoint.io@gmail.com.

5. Subscription and Pricing

• Price: €4.99/month (EUR).

• Billing cycle: Monthly, recurring.

• Auto-renewal: The subscription renews automatically every month until cancelled by you.

• VAT: Prices are shown in euros and include any applicable VAT. Where an invoice is issued, the VAT treatment is shown on the invoice. Users outside the EU may be subject to additional import or consumption taxes in their own jurisdiction.

• Price changes: We may change subscription prices with at least 30 days' prior notice by email. Changes apply to the next billing cycle after the notice period. You may cancel before the new price takes effect.

6. Right of Withdrawal (EU Consumers)

Under EU Directive 2011/83/EU, consumers resident in the European Union have the right to withdraw from a distance contract within 14 days, without giving any reason.

For digital content and digital services supplied otherwise than on a tangible medium, the right of withdrawal is lost once performance has begun, provided that the consumer (a) has given express prior consent to begin performance during the 14-day withdrawal period, and (b) has acknowledged losing the right of withdrawal as a result.

When you subscribe to Chesspoint you are explicitly asked to confirm both (a) and (b) at the checkout step. If you do not tick the consent box the subscription cannot be activated. Full details are in our Refund & Cancellation Policy.

7. Warranty and Conformity of the Digital Service

In accordance with EU Directive 2019/770/EU on digital content and digital services, we warrant that the Chesspoint Membership will:

• Conform to the description of the service published on the Membership page at the time of purchase;

• Be fit for the purposes for which digital services of the same type are normally used;

• Be supplied with the functionality, compatibility, and accessibility that consumers may reasonably expect; and

• Be supplied with updates necessary to keep the service in conformity throughout the subscription period.

If the service does not conform, you are entitled to have it brought into conformity, to a proportionate price reduction, or to termination of the contract in accordance with your mandatory consumer rights. Please report any lack of conformity through our Complaints Procedure.

8. User Accounts

You agree to:

• Provide accurate and complete information during registration;

• Keep your login credentials confidential and not share them;

• Notify us immediately of any unauthorized access; and

• Be solely responsible for any activity under your account.

9. Age Restriction

The service is intended for users aged 16 and over. Minors under 16 may only use the service with the consent and under the supervision of a parent or legal guardian, who accepts these Terms on their behalf.

10. Intellectual Property

All content on Chesspoint — text, graphics, logos, lessons, puzzles, software, and user interface elements — is the property of Računarsko programiranje "EREBUS" s.p. or its licensors and is protected by copyright and other intellectual property laws. Your subscription grants you a personal, non-exclusive, non-transferable, non-sublicensable licence to access and use the content for your own, non-commercial learning. You may not reproduce, distribute, publicly display, or create derivative works without our prior written permission.

11. Prohibited Uses

You agree not to:

• Use the service for any unlawful purpose;

• Attempt to gain unauthorized access to any part of the platform or other users' accounts;

• Copy, scrape, modify, or redistribute content without permission;

• Interfere with or disrupt the service, its infrastructure, or other users' use of it.

12. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. Subject to the foregoing, our total aggregate liability arising out of or in connection with these Terms or the service is limited to the total amount you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Bosnia and Herzegovina. The competent courts of Banja Luka, Bosnia and Herzegovina, have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection provisions of the law of the consumer's country of residence that grant the consumer a more favourable forum.

EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We will however primarily attempt to resolve disputes directly with the consumer through our Complaints Procedure.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
